Experts are needed to investigate the cause and origin of fires in buildings and vehicles which are insured. Arson fires are not insured, and are also illegal. This brings in government investigators from police and fire departments, as well as Fire Marshal’s. They have first access to the property and insurance investigators must wait until the scene is released prior to entering. This creates a problem of evidence disturbance so there must be cooperation between the various investigators in these fires.
The NFPA 921 guideline outlines an investigation protocol which has been adopted by most investigators, and now is used in court as an authoritative text on the subject. Our experts use this guideline, so our evidence is accepted in courts.
In addition to fire cause, other issues often require investigation for liability determination. We have experience in cases such as fire department liability for delayed response, improper suppression, or rekindles. We have worked on cases involving municipal liability for inadequate supply of water to suppress a fire due to improper maintenance of water mains, inadequate pumps or hydrants, and misuse of pumping equipment. These cases often require fire growth and spread analysis. Computer models are available to assist in these matters.
Subrogation and product liability claims require a very detailed investigation since they have more potential to reach the courts. Subrogation claims rely on a finding of negligence, which can take many forms. Product liability must establish a product defect, or a danger without adequate warning. We have extensive experience in these investigations and in the courtroom.
